To Record Telephone Calls Legally?
As general questions go, this is probably one of the most general. Is it legal to record telephone calls? Well, yes, maybe, and no, depending on your circumstances.
Let’s start with yes. If you ask the other party or parties to the conversation for their permission to record, and they give you that permission, it’s legal. Of course this is not legal advice, and if you have any doubts, you should check with an attorney. But, as a rule, if all parties consent to the recording, then it’s within the law.
Where maybe comes in is when you know you’re recording, but no one else on the line knows. In some jurisdictions you may be okay, as long as one party to the phone recording knows and consents. But if you are planning to record a conversation secretly, you should get very good advice from an attorney with experience in this field, before you record the conversation.
“No” comes in when you’re taping someone else’s conversations, and no one being recorded knows it. That would, actually, qualify as an illegal wiretap in most cases. That would be a very bad thing. Even if you have the most ironclad of reasons, unless you’re authorized by someone who has the legal authority to okay something like that, secretly taping other people’s phone conversations is always going to have some very serious consequences if you’re caught.
If you need to record phone calls, the best way to make sure you’re within the law is to get the permission of the other party. If for some reason you are unable to do that, you should be very sure about the laws in your location as well as the other person’s location, and be prepared to defend your position to the other person, informally if not in court.

Who can be Certified and Licensed Paralegals?

Paralegals are not lawyers or attorneys. Paralegals, also known as legal assistants are group of persons who assist the lawyers in the delivery of their legal services. Unlike lawyers, paralegals cannot give legal advice, accept cases and represent clients in court. Instead, they give aid to the lawyers in preparing for a certain cause, dispute, litigation or case, such as drafting necessary legal documents needed by lawyers, conducting legal research / investigations and the like.
A paralegal must be certified and licensed. Certified and Licensed Paralegals are group of people with formal education, training, experience regarding the legal system, substantive and procedural law which qualifies them to do work of legal nature under an attorney’s supervision. It would not be an exaggeration if one would claim that certified and licensed paralegals are much better than “ordinary paralegals.â€
There are several ways to become a certified and licensed paralegal. The most common is through a community college paralegal program that leads to a certification in paralegal studies. On the other hand, some employees hire college graduates and train them on the job to become paralegals. Later they are prepared to take the examinations required to be a certified and licensed paralegal.
Furthermore, the National Association of Legal Assistants (NALA) has established standards for becoming certified and licensed paralegals, requiring various combinations of education and experience. Those who meet these standards may take a two-day examination given three times a year in selected testing areas. The NALA offers an advanced paralegal certification for those who would want to specialize in other areas of the law. Moreover, the Paralegal Advanced Competency Exam, administered through the National Federation of Paralegal Association, offers professional recognition to certified and licensed paralegals with a bachelor’s degree and at least 2 years of experience.

Working in the Harter, Secrest and Emery law firm, Lois Smith has been cited as the legal assistant of the year by the Paralegal Association of Rochester. She is a certified and licensed paralegal where she was able to receive her recognition in May of 2006.
Lois Smith has been a certified and licensed paralegal in the Harter, Secret and Emery law firm for more than a decade now. She started her career since 1975 where she specializes in estate and trust administration.
